End User License Agreement (EULA) for KreateWebsites

Effective Date: Aug 2024

1. Introduction

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and Dataknobs (“Company,” “We,” or “Us”) governing your use of KreateWebsites (“Service”), a website builder and hosting service available on the Google Cloud Marketplace.

By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to this Agreement, you may not use the Service.

2. Grant of License

Subject to the terms and conditions of this Agreement, the Company grants you a non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes.

3. Restrictions

You agree not to:

  • Modify, adapt, translate, or create derivative works based on the Service.
  • Reverse engineer, decompile, or disassemble the Service.
  • Remove, alter, or obscure any proprietary notices or labels on the Service.
  • Use the Service for any illegal or unauthorized purpose.

4. Intellectual Property

All intellectual property rights in and to the Service are owned by the Company or its licensors. This Agreement does not grant you any ownership interest in the Service or any related intellectual property rights.

5. User Content

You retain all rights to the content you create or upload using the Service (“User Content”).

6. Privacy and Data Protection

We are committed to protecting your privacy. Our Privacy Policy, available at PrivacyPolicy, outlines how we collect, use, and safeguard your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Fees and Payment

Access to certain features of the Service may require payment of fees. You agree to pay all applicable fees as described in the pricing plan selected by you. All fees are non-refundable unless otherwise stated.

8. Termination

We may terminate this Agreement and your access to the Service at any time if you violate the terms of this Agreement.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We provide 99.99 SLA on website hosting. For Website builder we do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of Liability

In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

11. Indemnification

You agree to indemnify and hold the Company harmless from any claims, losses, liabilities, damages, costs, or expenses arising out of or related to your use of the Service or your violation of this Agreement.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Washington State, USA, without regard to its conflict of law principles.

13. Amendments

We reserve the right to modify this Agreement at any time.
